Acceptance of Terms

By accessing and using WhatsYourVibe, you accept and agree to be bound by the terms and provision of this agreement.

Use License

Permission is granted to temporarily use WhatsYourVibe for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title.

User Conduct

You agree to use the platform in a manner that is lawful, respectful, and does not infringe upon the rights of others. Harassment, hate speech, or inappropriate content will not be tolerated.

Content Ownership and Visibility

You retain ownership of any content you post on WhatsYourVibe. By posting content, you grant us a license to use, display, and distribute your content on the platform, including on public-facing pages such as the discover page, project feeds, and user profiles.

Important: Content you post on WhatsYourVibe is publicly visible. This means your projects, descriptions, images, and other content may be viewed by anyone who visits the platform. Please only share content you're comfortable making public.

DMCA Policy (for User-Generated Content)

We respect the intellectual property rights of others and expect our users to do the same. This DMCA Policy outlines how copyright owners can submit claims for infringing content, how we respond, and how users may respond with counter-notifications. We operate in compliance with the Digital Millennium Copyright Act (17 U.S.C. § 512).

Scope

This policy applies to all user-generated content hosted, uploaded, or posted on our platform, including but not limited to projects, posts, comments, images, and other materials contributed by users.

DMCA Designated Agent

All DMCA notices must be submitted through our contact form with the subject line specified above to ensure proper handling and documentation.

Notice of Infringement (Takedown Notice)

If you believe that your copyrighted work has been infringed by content on our platform, you must send a written notice that includes the following elements (per 17 U.S.C. § 512(c)(3)):

  1. Signature: Your physical or electronic signature.
  2. Identification of the work: A description of the copyrighted work you claim was infringed, or a list of multiple works.
  3. Location of infringing material: Identification of the specific material claimed to be infringing, including URL(s) or other information sufficient to locate it.
  4. Contact information: Your name, address, telephone number, and email address.
  5. Statement of good faith belief: A statement that you believe in good faith that use of the material is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy and authority: A statement under penalty of perjury that the information in the notice is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner.

Counter-Notification (Counter-Notice)

If content you posted is removed or disabled due to a takedown notice and you believe it was removed in error or misidentification, you may file a counter-notice pursuant to 17 U.S.C. § 512(g) including:

  1. Your physical or electronic signature.
  2. Identification of the removed or disabled material and where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled by mistake or misidentification.
  4. Your name, address, telephone number, and email address.
  5. A statement consenting to jurisdiction of the federal district court in your district (or where our service provider is located), and that you will accept service of process from the person who provided the original notice.

Response Procedure

After receiving a valid takedown notice:

  • We will promptly remove or disable access to the allegedly infringing material.
  • We will notify the user who posted the material.

After a valid counter-notice:

  • Unless the copyright owner files a court action within 10-14 business days (or as specified by statute), we may restore the material.

Repeat Infringer Policy

We reserve the right to terminate user accounts of repeat infringers in appropriate circumstances in compliance with the DMCA safe harbor rules. A repeat infringer is defined as a user who has been the subject of multiple valid DMCA takedown notices.

User Responsibilities

Users should ensure that any content they upload does not violate copyright or other intellectual property rights. Content should only be uploaded with proper authorization or license from the copyright owner, or if the content is original work created by the user.

Misrepresentation and Penalties

Under 17 U.S.C. § 512(f), any person who knowingly submits false information or misrepresents that material is infringing may be liable for damages, including costs and attorney's fees. This applies to both takedown notices and counter-notices.

Idea Protection and Risks

WhatsYourVibe is a public platform designed to showcase ideas and projects. While we encourage sharing and collaboration, we want to be transparent about the risks involved.

Idea Theft Risk: When you share ideas, concepts, or project details publicly, there is a risk that others may copy or use your ideas. Ideas themselves are generally not protected by intellectual property laws—only tangible implementations (like working products, code, designs) can be protected.

The best protection for your ideas is having a working product, documented development process, or other evidence of creation. We recommend documenting your work, keeping records of your development timeline, and considering appropriate intellectual property protections (patents, trademarks, copyrights) for implementations you want to protect.

By using WhatsYourVibe, you acknowledge these risks and agree that ThinkAheadAI is not responsible for unauthorized use of ideas or concepts shared on the platform.

Limitations of Liability

We work hard to provide a secure, reliable platform, but we cannot guarantee that WhatsYourVibe will be error-free, secure, or uninterrupted. We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform.

We are not responsible for content posted by users, including any harm that may result from viewing or interacting with user-generated content. We do not endorse or verify the accuracy of user-posted content.

To the maximum extent permitted by law, our total liability for any claims related to WhatsYourVibe is limited to the amount you paid us (if any) in the 12 months preceding the claim.

WhatsYourVibe is created and operated by ThinkAheadAI. These Terms of Service govern your use of the WhatsYourVibe platform and services provided under the ThinkAheadAI brand.
